1. Who you are buying from, and scope
These terms govern sales made through the ViraVie store by ISARDI LTD, a private company limited by shares registered in England and Wales under number 17398968, whose registered office is at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. Contact: support@vira-vie.com
We sell and deliver to the United Kingdom only.
By placing an order you confirm that you have the legal capacity to do so and that you are acting as a consumer, unless otherwise agreed in writing. The terms that apply are those available at the time of your order. Your mandatory rights as a consumer remain fully applicable.
2. Products
We describe the essential characteristics of each product with care. Slight variations in colour may result from the screen you are using or from normal manufacturing variation. These do not limit your rights if the product you receive does not match its description.
3. Prices and taxes
Prices are shown in pounds sterling (GBP) and include UK VAT where applicable. The total price, applicable taxes and delivery charges are presented before you confirm your order. You will not be charged any amount beyond that total.
No customs duty, import VAT or handling fee will be requested from you on delivery. Where an order is dispatched from outside the United Kingdom, all import formalities and charges are handled and paid by us before dispatch.
4. Orders and formation of the contract
Before paying, you can review and correct the contents of your basket and your details. Clicking the final payment button constitutes an offer to buy with an obligation to pay. An automatic acknowledgement is sent by email. The contract is formed when we confirm acceptance of your order or dispatch it.
We may refuse or cancel an order for a legitimate reason, including unavailability of the product, an obvious pricing error, an inability to deliver, a reasonable suspicion of fraud, or non-payment. Any sums already taken for a refused order are refunded.
5. Payment
The available payment methods are shown at checkout. Payment is handled by Shopify and by the payment providers enabled on the store. You undertake to provide accurate information and to be authorised to use the payment method chosen.
6. Delivery
Destinations, charges and times are set out in our Shipping policy.
Unless a different period is expressly agreed, your order is delivered within 30 days of the contract being concluded, in accordance with section 28 of the Consumer Rights Act 2015. If that period is exceeded, you may give us a reasonable additional period and, if delivery still does not take place, treat the contract as at an end and obtain a refund.
Until you take physical possession of the product, we bear the risk of loss or damage where we have chosen the carrier.
7. Withdrawal, returns and refunds
You have 14 days from the day after receipt to notify us that you wish to cancel, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, on the terms set out in our Refund policy. The direct cost of returning the product where you have simply changed your mind is yours to bear. The costs necessary to deal with a faulty or non-conforming product are ours.
8. Legal rights
Under the Consumer Rights Act 2015, products must be of satisfactory quality, fit for purpose and as described. If they are not, you have a short-term right to reject within 30 days of receipt for a full refund. After that period you are entitled to a repair or a replacement and, if that fails, to a price reduction or a refund.
These rights apply for up to six years in England, Wales and Northern Ireland, and five years in Scotland. Any commercial warranty is in addition to your legal rights and does not replace them.
9. Use of the site
You must not use the site fraudulently, unlawfully, or in any way likely to compromise its security or operation. The content of the site is protected by applicable intellectual property rights and may not be exploited without authorisation.
10. Liability
Nothing in these terms excludes or limits any liability that cannot lawfully be excluded, in particular for fraud, wilful misconduct, death or personal injury caused by negligence, defective products, or infringement of consumers' mandatory rights. To the extent permitted by law, we are not liable for indirect losses that were not reasonably foreseeable when the contract was concluded.
11. Events outside our control
We are not liable for delay directly caused by an external event that could not reasonably be foreseen and could not be overcome. We will inform you and take reasonable steps to limit the consequences. Your rights in the event of prolonged delay are unaffected.
12. Personal data
The processing of personal data is described in our Privacy policy. Payments are handled by specialist providers; we do not necessarily receive your full card details.
13. Complaints and dispute resolution
For any complaint, please first contact support@vira-vie.com so that we can seek an amicable solution. We undertake to acknowledge your complaint and respond within a reasonable time.
If a mandatory mediation or alternative dispute resolution scheme applies in your country of residence, you retain the right to use it, and the contact details of the competent body will be provided to you in accordance with applicable law.
14. Governing law and jurisdiction
These terms are governed by the law of England and Wales. This choice does not deprive you of the protection of the mandatory provisions of the country in which you habitually reside. You may bring proceedings before the courts having jurisdiction under applicable consumer protection rules, including those of your place of residence where those rules so permit.
15. Final provisions
If any clause is held to be invalid, the remaining clauses continue to apply. A failure to exercise a right immediately is not a waiver of it. We may update these terms for the future; the version applying to an order remains the one accepted when that order was placed.
